Parental Relocation
Life after divorce is full of just as much, if not more change than before. Because of this, revisiting the terms of a divorce long after the divorce itself is not uncommon. In terms of child custody, parental relocation and Florida law however, there are specific factors that the courts will consider in determining whether or not the custodial parent can relocate the child.

Custody Move-Away Dispute: Florida Law
In my practice as a Broward County family law attorney, I represent parents with primary residential custody who are seeking permission to relocate with their child, and parents with secondary residential custody seeking to oppose their former spouse’s proposed move. Recently, the Florida legislature enacted a new statute that increases the number of factors courts consider in these “move-away” cases from six to 11.
Factors include (but are not necessarily limited to):
- Whether the courts can determine that the move is in the best interest of the child
- The impact the relocation will have on the child’s development and well-being
- The child’s preference on whether to move
- Compliance with existing visitation rights for the noncustodial parent and how the move will impact future visitation rights
No matter which side of this issue you fall on, the best thing you can do is seek out the guidance and representation of a lawyer as soon as possible. As a Certified Family Law Specialist* with more than two decades of experience handling family law issues involving custody, I can provide you with the kind of skill and dedication you need.
